Saint Lucia

Overview
Saint Lucia is an independent Commonwealth state whose legal system blends English common law with certain civil-law influences in its property regime. It forms part of the Eastern Caribbean Supreme Court (ECSC), sharing the region's High Court and Court of Appeal framework, with final appeals to the Judicial Committee of the Privy Council in London.

Elliott-Hamilton Law maintains a staffed office in Saint Lucia, advising regional and international clients across corporate, real estate, and secured lending matters.

International business companies. Saint Lucia is a leading jurisdiction for international business, offering the International Business Company (IBC) as a flexible vehicle for regional and cross-border activity, alongside a citizenship-by-investment programme that supports its position as an investment gateway. We advise on IBC formation, cross-border structuring, holding and operating company arrangements, financing, and ongoing corporate governance and compliance.

Real estate and developments. Acquisitions of land by non-nationals require an Alien Landholding Licence, and transactions attract stamp duty and related statutory processes. Our practice focuses on real estate developments—advising sponsors and investors on site acquisition, development structuring, concessions, and the associated licensing and conveyancing on both the acquisition and disposal sides.

Secured lending. Saint Lucia's Security Interests in Movable Property legislation provides a modern framework for taking, registering, and enforcing security over movable assets. We advise lenders and borrowers on structuring secured facilities, creating and perfecting security interests, registration, priority, and enforcement under the regime.

Litigation and dispute resolution. We appear across the ECSC's High Court and Court of Appeal in Saint Lucia, acting in commercial litigation, appellate matters, judgment enforcement, and arbitration.

With a staffed local presence, a Chambers-ranked regional practice, and TerraLex membership, the firm combines on-the-ground depth in Saint Lucia with the cross-border reach expected by international clients and referring counsel. Whether structuring an IBC, closing a development, or perfecting security, we provide precise, primary-source-driven advice grounded in the law of Saint Lucia
